Three years ago he was ousted from the spot by his deputy, Julia Gillard, who had kept the spot til now.
The change happened with general elections set for September 14.
Gillard had become increasingly unpopular, despite keeping Australia one of the few countries in the world to see economic growth while expanding funding for schools and the disabled.
Her unpopularity was due to her passing of a carbon tax, which she had promised to not vote for.
The Labor Party is hoping that the switch will keep them in power.
However, Rudd's take over has caused divisions within the party, that could cause a split come election time.
